As we head into 2026, geopolitics and economic competition continue to push the U.S. to adopt more and more-stringent—and often unilateral—economic security measures. We will discuss what to expect in 2026, especially in terms of anti-diversion and ant-evasion enforcement by U.S. agencies, and how compliance professionals can best prepare.

  • What are the key lessons learned from the most-recent U.S. sanctions enforcement actions, especially as to the role of “gatekeepers” like lawyers and indirect property interests.

  • Why the U.S. DOJ has previewed an increasing focus on offshore Variable Interest Entities (VIEs).

  • What are the key lessons learned from the most-recent U.S. export controls enforcement actions, especially around General Prohibition 10, the concept of “knowledge” to include not only actual knowledge but “an awareness of a high probability,” and the impact on not only exporters but financial institutions involved in export or import transactions.

  • What to make of the August 2025 creation of the Trade Fraud Task Force and recent DOJ statements highlighting criminal enforcement (not just administrative or civil fines) for alleged tariff-evasion.
